Commercial and Insurance Coverage Litigation
We represent clients throughout the country in litigation/arbitration/mediation usually involving contract disputes – heavily focused on policyholder insurance recovery, breach of various commercial agreements, and equitable claims among non-contracting parties. We litigate a wide array of business torts, enforcement and defense of merger and acquisition claims, defend our clients in toxic tort/asbestos and other personal injury type claims, co-op/condo board disputes, construction and design defects, mechanics liens, as well, other types of civil and administrative actions.
Corporate Transactions
Including commercial secured transactions, such as: trade credit, accounts receivable financing, and collateral based commodity financing agreements. We can support transactional due diligence, negotiating and drafting of complex agreements within a diverse array of commercial transactions, supporting clients in financing, private equity and venture capital.
Environmental
For developers/builders, sellers, purchasers, REITs, owners, investors, lenders, borrowers, landlords and tenants. All aspects of federal, state and local environmental law including due diligence, regulatory compliance, risk management, insurance, and litigation (cost recovery, toxic tort, and property damage defense).
Risk Management
Acting as outside risk managers for clients, including a multi-national chemical/mineral manufacturing corporation, handling the negotiation and placement of all lines of insurance, managing the day-to-day interface between internal corporate clients and the external customer/supplier/other insurance needs and claims, as well as, when necessary, coverage counsel for the resolution of disputed insurance claims.
